GENERAL CONDITIONS OF SALE
1. SUBJECT
1.1 These General Conditions of Sale apply to purchases made through the Website www.rbwskull.com by consumers and/or professionals (hereinafter referred to individually or jointly as the “Customer”).
They constitute the contractual rules applicable in relations between the Customer and RBW-SKULL S.r.l., an Italian company with registered office at Viale Premuda no. 46, Milan, postcode 20129, Italy, VAT number 08720660961 (tax code and registration in the Companies Register 08720660961), owner of the Website www.rbwskull.com.
Depending on the purchaser – consumer or professional buyer who finalises the contract – different rules and regulations will apply.
Every purchase made on the website www.rbwskull.com is subject to the legislation referred to in EU Regulation no. 679/2016, Italian Legislative Decree no. 196/2003 and Italian Legislative Decree 205/2006.
The contract subject to these General Conditions of Sale relates to the purchase and sale of products marketed by RBW-SKULL S.r.l. in the quantity and type chosen by the Customer, via electronic selection on the Website www.rbwskull.com.
1.2 From the moment when the Customer accesses and uses the Website www.rbwskull.com, they are placed in the condition of knowing these General Conditions of Sale before confirming their purchases.
1.3 The Customer must accept the Conditions by ticking the box “I accept the General Conditions of Purchase’ which appears during the online purchase procedure. Without express acceptance of the Conditions, it will not be possible to complete the purchase procedure. With the acceptance of the Conditions and therefore with the issuance of the purchase order, the purchaser will agree to receive all communications related to fulfilling the order, sent to the email address indicated at the time of registration.
The placing of the order (or the acceptance by the Customer of the purchase proposal formulated by RBW-SKULL S.r.l.) therefore implies knowledge of these General Conditions of Sale and their acceptance.
1.4 The contract is concluded exclusively through the internet, through the Customer accessing the Website www.rbwskull.com, by sending a purchase order according to the procedure provided for by that site and its acceptance by RBW-SKULL S.r.l.
1.5 The purchase order sent by the Customer through the Site has the value of a contractual proposal and is governed by these general conditions of sale, which the Customer is required to accept in full and without any reservation.
1.6 The sales contract is concluded when RBW-SKULL S.r.l. sends the Customer an email confirming the order. The email contains the Customer’s data, the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.
The customer undertakes to check that their personal data contained therein is correct and to promptly inform RBW-SKULL S.r.l. of any corrections.
In the order confirmation email, the Customer will also receive the link to download and archive a copy of these general conditions of sale, as required by Article 51, paragraph 1 of Italian Legislative Decree 206/2005, amended by Italian Legislative Decree 21/2014.
1.7 RBW-SKULL S.r.l. and the Customer, in compliance with the mandatory provisions of the law, agree that if certain provisions of these General Conditions of Sale are declared null or void, this fact will not affect the validity and effectiveness of the other provisions, which will remain fully valid and effective.
1.8 The Contract is concluded in Italian. In the event of a conflict between the versions of the General Conditions drawn up in a language other than Italian and accepted by the Customer, the meaning and interpretation of the General Conditions in Italian prevail.
2. PURCHASE METHOD
2.1 Purchases of the products, available as represented and described on the Website www.rbwskull.com in the descriptive tabs, are made at the price indicated therein, expressed in euros including VAT. The prices shown are valid for all countries in the world. Transport costs are not included in the price, but are displayed separately at the time of purchase by the Customer. Before confirming the purchase, the unit cost of each selected product, the total cost in the case of multiple products and the relative transport costs will be summarised.
2.2 When they confirm the purchase by sending the order, the Customer will receive an email sent to the address communicated to RBW-SKULL S.r.l., containing the date and total amount of the order and its details (including the characteristics of the item purchased, the total and broken-down cost of the product with indication of the various expense items). The amount of shipping costs for the delivery of goods in Italy or abroad will depend on the quantity, weight and size of the product purchased by the Customer.
2.3 Any additional costs such as customs duties, import taxes, local taxes, local VAT and/or other ancillary charges are the responsibility of the recipient. The customer assumes all responsibility for the accuracy of the data provided for billing and shipping the purchased products.
2.4 RBW-SKULL S.r.l. reserves the right to modify the price lists by updating them at any time. In the event of modification, the changes will not affect purchases the Customer has already ordered.
3. OTHER METHOD AND BILLING
3.1 Orders are made via electronic selection on the Website www.rbwskull.com.
The sending of the order, to be understood as the Customer’s acceptance of the RBW-SKULL S.r.l. purchase proposal, determines the conclusion of the contract and consequently entails the obligation to pay the price, as detailed in the summary and in the email, referred to in point 2 above.
The delivery of the product is subject to payment of the full amount by the Customer with one of the permitted payment methods.
3.2 Those persons obliged to request an invoice must provide the VAT number and all data necessary for its issue. The tax invoice can also be issued after the delivery of the goods, within the time limits established by law.
4. PAYMENT METHOD
4.1 The prices on the website www.salvahd.com are valid only for the whole world and include VAT.
4.2 Payment for the purchased products and the relative shipping costs can be made using one of the credit cards available and indicated on the Website www.rbwskull.com or through the online payment service PayPal or credit cards.
Through the PayPal online payment service, the Customer will be redirected to a page of the PayPal Website where they will enter their email address and a password and make the payment. The payment data entered by the Customer will not be shared with RBW-SKULL S.r.l., but will be managed directly by PayPal, as the independent data controller of this data. Furthermore, all communications relating to credit cards and similar payments take place on dedicated lines made available by third parties who own the payment systems.
In the event of cancellation of the order or non-acceptance by RBW-SKULL S.r.l., the amount will be refunded to the customer’s PayPal account.
RBW-SKULL S.r.l. will not be responsible for delays and/or damages caused during the refund phase.
4.3 In exceptional cases when RBW-SKULL S.r.l. cancels the order due to unexpected product unavailability, including in relation to the quantities ordered, the amount already paid will be refunded with the appropriatemethods, according to the payment method used by the Customer.
5. DELIVERY METHODS
5.1 RBW-SKULL S.r.l. makes deliveries to the Customer using specialised couriers. The purchased products are delivered directly to the address indicated during the purchase procedure. Each shipment contains the ordered product and its accompanying documentation.
5.2 The purchased products will be delivered no later than 30 (thirty) days from the date of receipt of the order. The delivery date will be indicated, following the order confirmation, by RBW-SKULL S.r.l. via a specific email.
5.4 RBW-SKULL S.r.l. is not responsible for non-fulfilment or delays in execution of the order due to causes of force majeure such as, by way of example, suspension of transport, work interruptions, or trade union action.
5.5. The Customer can follow the status of the shipment of their order by connecting to the carrier link indicated in the shipping confirmation email.
5.6 Upon delivery, the Customer is required to verify that the package is intact, not damaged or wet. Only after this verification will they have to accept the delivery, otherwise they will be required to reject the package. If the goods arrive at their destination broken or damaged, RBW-SKULL S.r.l. undertakes to replace the product at its own expense, only and exclusively if the recipient has found the breakage or damage in the presence of the courier who made the delivery or if they have indicated ACCEPTANCE WITH RESERVATION on the receipt document.
If the order and delivery do not match, the Customer must raise the dispute by sending an email to the address mysalvahd@gmail.com
6. RIGHT OF WITHDRAWAL
6.1 The Customer has the right to withdraw from the contract without any penalty and without specifying the reason within fourteen days from the day when they acquire possession of the purchased product, by sending an email to mysalvahd@gmail.com, which must indicate their first name and surname, the order number/code, the product references and, if deemed appropriate, also the reason for the return.
6.2 The Customer is obliged to return the products to RBW-SKULL S.r.l. within fourteen days from the day when the Customer notified their withdrawal from the contract. The goods must be returned to RBW-SKULL S.r.l. intact, in unaltered conditions, complete with the original packaging.
The costs and risks associated with returning the products are borne by the Customer.
6.3 A Customer who withdraws from the contract will be refunded the payments made to RBW-SKULL S.r.l. includingdelivery costs within thirty days from the day when RBW-SKULL S.r.l. is informed of the decision to withdraw from the contract, and in any case not before it has received the return shipment with the returned product and verified the state of the product itself. These refunds will be made using the same payment method used for the initial transaction, unless the Customer has expressly agreed otherwise with RBW-SKULL S.r.l.
6.4 The right of withdrawal can only be exercised by natural persons acting for purposes that can be considered unrelated to their commercial activity (consumer Customer). The right of withdrawal cannot be exercised by legal persons and natural persons acting for purposes related to a commercial, entrepreneurial, craft or professional activity.
6.5 Purchases made by resellers or by those who in any way purchase for resale to third parties are also excluded from the right of withdrawal. The right of withdrawal does not apply to the supply of goods made to measure or clearly customised.
7. PRODUCT WARRANTY
7.1 All products purchased on the Site are covered by the legal warranty.
7.2 Any lack of conformity of the product must be reported according to the terms and conditions set out in Article 132 of Italian Legislative Decree 206/2005, by sending an email to the address: mysalvahd@gmail.com
8. PRODUCT INSTALLATION, MAINTENANCE AND USE
8.1 The purchased products must always be installed and used in accordance with the instructions and warnings provided in the technical documentation, available on the Website www.rbwskull.com.
8.2 To install a Product, RBW-SKULL S.r.l. recommends requesting the intervention of specialised technical personnel. Otherwise, RBW-SKULL S.r.l. as of now accepts no liability for damage to things or persons due to the incorrect installation and/or use of a Product.
9. LIALIBITY OF THE SELLER
9.1 RBW-SKULL S.r.l. assumes no liability for any damage resulting from incorrect use of the service provided by the Website www.rbwskull.com.
RBW-SKULL S.r.l. assumes no liability for errors and omissions on the site www.rbwskull.com or any Website which may be referenced or linked.
RBW-SKULL S.r.l. reserves the right to continuously update the site www.rbwskull.com, which can be done at any time.
RBW-SKULL S.r.l. does not guarantee that the services provided by the Website www.rbwskull.com will be provided without interruptions; this will be communicated in advance, unless it occurs for reasons beyond the control of RBW-SKULL S.r.l.
9.2 RBW-SKULL S.r.l. assumes no liability for inefficiencies attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, epidemics and other similar events that prevent, in whole or in part, execution within the times agreed in the contract. RBW-SKULL S.r.l. will not be liable to the Customer for damages, losses or costs incurred as a result of the non-execution of the contract for the reasons mentioned above, with the Customer only being entitled to a refund of the price paid.
9.3 RBW-SKULL S.r.l. informs the Customer that each order sent is stored in digital/paper form at the Seller’s headquarters or on an information system of the Seller’s service providers.
10. INTELLECTUAL PROPERTY
The Customer is required to ensure that their data entered is true, complete and up-to-date, and to promptly communicate any changes thereto. In the event that the Customer makes false statements, Savior S.r.l. reserves the right to exclude such Customers from their user lists, after a formal and unaccepted invitation to self-correct.
11. INTELLECTUAL PROPERTY
11.1 The pages of the Website www.salvahd.com do not intend to reproduce any material subject to copyright or in violation of the law; furthermore, for any original and protected material published on the Website www.rbwskull.com, the source is cited; in the event of an infringement of material subject to copyright, whoever the owner, please notify RBW-SKULL S.r.l. (via email to the address mysalvahd@gmail.com), which will investigate immediately and provide a prompt response. It should be noted that each product or product name and their description, each denomination and related description, company, entity, personal name, brand and logo mentioned on this Website are trademarks or designs belonging to their respective owners and may be
protected by patents and/or copyrights granted or registered by the relevant authorities.
11.2 All content of the website www.rbwskull.com such as texts, files, tables, information present within the pages of the website, graphics, HTML, logos, buttons, icons, images, graphics, audio-video excerpts, all the software, source codes, application projects, formulas, algorithms and databases used on the Website www.rbwskull.com are to be considered the exclusive property of RBW-SKULL S.r.l. or its content and product suppliers, and are protected by national laws (Italian Law 663/1941 and subsequent amendments) and international laws on copyright and industrial property (Italian Legislative Decree no. 30/2005, Industrial Property Code).
12. PRIVACY and COOKIES
12.1 As regards the processing of personal data of Customers of the Website www.rbwskull.com and cookie management, please refer to the content of the statement on data processing (privacy policy) and on the use of cookie technology (cookie policy) published and available at the following link: https://salvahd.com/it/privacy-policy.
12.2 The Customer is informed that the use of this Website www.rbwskull.com or the transmission of an order through it implies acceptance of these Data Protection Policies.
13. APPLICABLE LAW AND JURISDICTION
13.1 This contract is governed by the regulatory provisions of Italian law.
13.2 The contract concluded between RBW-SKULL S.r.l. and the consumer-Customer is governed by the provisions of the Italian Civil Code, to which reference should be made for everything in this context not expressly provided for, and by the provisions of Italian Legislative Decree no. 206/2005 (so-called Consumer Code).
13.3 The contract concluded between RBW-SKULL S.r.l. and the professional-Customer is governed by the provisions of the Italian Civil Code, to which reference is made.
13.4 The Court of Milan is exclusively competent for any dispute related to the contract and these General Conditions of Sale that may arise between RBW-SKULL S.r.l. and the Customer.
13.5 Pursuant to EU Regulation no. 524/2013 and Italian Legislative Decree no. 130/2015, the consumer can also use the Online Dispute Resolution (ODR) platform for out-of-court resolution for online dispute resolution.
